However, the certifier preferred that an Access Modification Decision be sought through the Northern Territory Building Appeals Board on the basis of unjustifiable hardship.

Through complex consultation and negotiation, the case was presented and approved with consideration to geographical limitations and the potential detriment likely to be suffered by compliance. Evidence was presented about the efforts made in good faith to explore compliant options such as a low-rise platform lift and a ramp incorporating a landing. It should be noted that this variation was not sought for financial reasons and that the resulting preference by all stakeholders for the single run ramp was due to physical space constraints and for optimum functional use by the occupants.
